- 雇主表示因企业重组,员工的工作岗位已不再被需要,因此出现员工过多(redundant)的现象, 而发出了裁员通知。
- 雇主声称,员工在接到裁员通知后同意了一项遣散费方案,其中包括公司支付他一个月的薪水,年假金和遣返费用。员工由始至终并没有提出异议。
- 然而员工表示他拒绝公司的任何遣散费方案,同时他们之间也没有签署任何互惠遣散计划( mutual separation) 的协议,但雇员承认他已经收到公司bank in 的遣散费,但在律师的建议下,他尚未退还此遣散费。员工随后将此事带到工业法庭,投诉被公司不合理的解雇。
- 当员工接受了遣散费,是否意味着他已经接受了解雇? 那之后员工还能提出不合理解雇的诉求吗?
- The law goes so far as to say that an employee may even sign a clause stating that he has no further claim, and yet he may file such a claim. It is well settled that estoppel, limitation and laches have no place in industrial jurisprudence.
