- 买家与发展商签署了买卖协议SPA ，以购买房产。
- SPA 第 25(1) 条文规定，发展商将在签署SPA之日起的54个月内交空屋。买家表示依据分层建筑物的附表H/Schedule H，发展商其实需要在36个月内交空屋。买家通过法庭申请有关协议void ab initio/自始无效。
- 地方法庭(Sessions Court)批准了买家的申请。法庭表示，联邦法庭已经在Ang Ming Lee & Ors v Menteri Kesejahteraan Bandar, Perumahan dan Kerajaan Tempatan & Anor and other appeals [2020] 1 MLJ 281中裁定，房屋管制处也无权批准任何发展商要求延长交屋期的期限。地方法庭因此宣布有关协议是无效的。
- 发展商上诉至高等法庭。
- 高等法庭同意有关的SPA的确违反了Schedule H的规定；然而法庭表示，这并不代表整个买卖协议都会是无效的。
- 买家有权通过法庭，命令发展商依据Schedule H所提及的36个月内交空屋，而并非让法庭宣布整份协议是完全无效的… I am of the view that Parliament intended that any Sale and Purchase Agreements entered under the Act must comply with the strict time frame of thirty-six (36) months. Parliament did not however provide that the contravention of the said legislation would render the Agreement void as contended by the Respondent.
- 法庭继续说明，联邦法庭在Ang Ming Lee一案中， 仅表明房屋管制处的延长期限的权力；并没有裁定整个买卖协议完全无效。
- 法庭因此搁置了地方法庭的庭令，宣布有关SPA是有效且可执行的；但条件是有关交空屋的部分必须遵守Schedule H中规定的36个月期限。
