构成诽谤的条件-[2018] 2 MLJ 654

一家公司在员工离职后，登报公示离职员工的信息。
公司在有关公示上的内容指该员工目前已经离职，并呼吁他回公司处理还没解决的问题。
员工提告公司诽谤，他指这导致其他人认为他在行为上不道德和不诚实… a cursory reading the notice would obviously mean that the plaintiff was an unethical and dishonest businessman.
高等法庭批准了员工的诉讼。公司之后上诉至上诉法庭。
法庭指出，有关陈述必须满足以下条件才能构成诽谤：
- 语句必须拥有诽谤的性质：
- 语句针对原告：原告必须能够证明那些诽谤性语句是针对他。被诽谤的对象必须明确，或者虽不明说却明确影射某个对象。针对性语句可以是指名道姓或很明确间接映射。
- 有“散播”（Publication）让第三者听到或看到：-诽谤性语句的成立，必须证明被散播出去让第三者听到或看到。若被告只是对着原告说出诽谤性的指责，不能构成诽谤
- the burden of proof lies on the plaintiff to show:
  (i) the words are defamatory;
  (ii) the words refer to the plaintiff; and
  (iii) the words were published
上诉法庭表示有关的公示内容并没有指出员工在行为上不道德或不诚实，只是让员工在看到公示后，回到公司解决一些问题…ordinary person reading the notice would not assume anything defamatory of the same. The notice did not accuse the plaintiff of any wrongdoing. Instead, the plaintiff was required to contact the first defendant to settle outstanding issues between them. The words in the notice definitely did not have the effect and/or meaning as ascribed by the plaintiff (see paras 29-30).
上诉法庭批准了公司的申请。
