联邦法庭：代复职赔偿金案例

员工在公司任职了17年，他在距离强制退休年龄仅14个月时被辞退。员工当时到工业法庭做投诉被公司无理辞退。工业法庭当时批准了员工的申请，公司需要赔偿他compensation in lieu of reinstatement/代复职赔偿金，以及24个月的backwages。
公司通过高等法庭申请司法复核，以撤销上诉法庭的判决。高等法庭当时驳回了公司的申请，不过考虑到员工即将退休，因此将24个月的backwages赔偿缩短为14个月。公司对此判决依然不满，最终上诉至联邦法庭。
公司的理由是，员工在审讯期间已经退休，根本无法复职；因此他无权获得compensation in lieu of reinstatement。
联邦法庭批准了公司的上诉申请。
法庭指出， compensation in lieu of reinstatement的前提是，员工能够被复职，只是赔偿会是更好的首选来代替它…reading the words “compensation in lieu of reinstatement” in plain English it means that such compensation was meant to be a replacement or a substitute or an alternative to reinstatement…
由于员工在审讯期间已经到了退休年龄，已经无法被复职；因此他无权获得代复职赔偿金。Obviously, the second respondent could not be reinstated or in a position to be reinstated when he was already as at the date of the award reached or passed the retirement age.
