单方与双方申请的离婚的分别

马来西亚的非回教徒离婚的种类基本上分为两种，那就是双方面同意离婚和单方面离婚。

(a) 双方面申请离婚

• 一对合法夫妻可以在双方面同意所有的离婚条件的情况下，申请离婚。
• 双方必须注册结婚超过两年。
• 离婚申请文件里会注明双方谈好的条件，包括孩子的抚养权，探望权，小孩的抚养费，女方的赡养费，产业分配以及其他的特别条件。
• 双方面同意申请离婚的律师费和费用，比单方面申请来得较低。律师费将取决于以下的因素:

1. 1. 律师是否参与与双方谈判离婚条件。如有，律师花了多少时间跟你还有对方谈判离婚条件;
   2. 离婚条件的复杂程度，律师需要多久时间拟和修改离婚条件/文件;
   3. 律师用了多少专业和时间给你意见; 和
   4. 律师出席了多少次会议和法庭。

• 离婚案件需要多久才能解决？这主要取决于以下因素:

1. 1. 你聘请的律师的办事效率和处理案件的经验;
   2. 双方多久签离婚申请文件;
   3. 法庭的排期上法庭的日期;
   4. 双方有没有申请押后法庭设定的上法庭日期 (一方突然要修改条件或者不能出席法庭设定的上法庭日期); 和
   5. 双方有没有临时更改任何离婚条件。

• 双方签了离婚文件，必须上一次法庭。
• 法庭批准了双方的离婚，离婚证书会在上法庭的第4个月（3个月的冷静期+1个月处理离婚证书）拿到。离婚证书是你聘请的律师处理，你是不需要自己跑法庭弄的。你的律师也会给你一份离婚证书。
• 除非你有特别的情况要求法庭去除3个月的冷静期，比如说：你打算下一个月结婚注册新的婚姻，或者你打算长期出国公干/定居，或者你们的婚姻不可能复合（有些法官不接受这个理由），法庭会批准你的离婚立刻生效，离婚证书会在上法庭的1个月（1个月处理离婚证书）拿到。
• 婚姻注册局需要3个月（从他们接收你的律师呈交文件的日子开始算起）将你的结婚状态从“已婚”转去”离婚“。

(b) 单方面申请离婚

• 单方面也可以申请离婚 (Single/Unilateral Petition)。
  • 其中一方，可以在另一方不同意的情况下，自行提出离婚。提出离婚的原因可以是:1.另一方有外遇;

    2.另一方的不合理的行为举止，让申请者无法继续和他/她相处下去;

    3.另一方抛弃申请者两年或以上; 或者

    4.夫妻双方已分居 (或分房) 超过两年。

  • 单方面申请离婚，过程和手续比较复杂。
• 一般来说，无法达成协议的离婚案件，处理的时间比较长，律师费比较高。
• 如果对方没有争议你的单方面申请，法庭手续时间大概是 4-12个月(视情况而定) + 4-6个月的JPN婚姻辅导。
• 首先，欲申请离婚的单方，必须先到国民登记局 (JPN) 的结婚和离婚部门，填写表格。
• 接着JPN的协调小组将预先通知双方辅导的日期，并进行3次不同日期的婚姻辅导，主要是为了挽救婚姻。这个过程需要耗时4-6个月的时间。
• 申请人必须双方都同意的地区或者是最后同居的地区所属的JPN提交表格。所需文件包括：

1. 1. Borang KC14 （向柜台索取）
   2. 身份证 / 正本护照
   3. 正本和副本的结婚证书 
   4. 其他相关文件 （如果有的话）

• 婚姻仲裁局会在6个月以内解决问题，并会通知双方出席听证会。一般来说，会有至少两次以上的面试。
• 若协调小组认为此段婚姻已经无法挽救了，就会颁布婚姻破裂证书。之后就可以去找律师向法庭申请单方面离婚了。
• 如果对方有出席最少一次的协调，JPN会发一封KC29的信。如果对方有3次都没有出席，JPN会发一封KC28的信.
• 欲申请离婚的一方有了KC28或者KC29，就能够找律师办理离婚·手续了。
• 如果对方全程没有出席或者请律师抗辩你的离婚申请，到最后，你申请什么条件，法官一般都会批准。
• 如果对方请律师抗辩，你可以选择谈判条件或者打官司，让法官作出最后判决。
• 法庭批准了你的离婚，离婚证书会在上法庭的第4个月（3个月的冷静期+1个月处理离婚证书）拿到。离婚证书是你聘请的律师处理，你是不需要自己跑法庭弄的。你的律师也会给你一份离婚证书。

Law Reform (Marriage & Divorce) Act 1976

54.Proof of breakdown

(1) In its inquiry into the facts and circumstances alleged as causing or leading to the breakdown of the marriage, the court shall have regard to one or more of the following facts, that is to say:

(a) that the respondent has committed adultery and the petitioner finds it intolerable to live with the respondent;

(b) that the respondent has behaved in such a way that the petitioner cannot reasonably be expected to live with the respondent;

(c) that the respondent has deserted the petitioner for a continuous period of at least two years immediately preceding the presentation of the petition;

(d) that the parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of the petition.

(2) In considering whether it would be just and reasonable to make a decree the court shall consider all the circumstances, including the conduct of the parties and how the interests of any child or children of the marriage or of either party may be affected if the marriage is dissolved and it may make a decree nisi subject to such terms and conditions as the court may think fit to attach, but if it should appear to the court that in all the circumstances it would be wrong to dissolve the marriage it shall dismiss the petition.
