人力资源部:11月28日属于有薪假/补假

人力资源部指出，新任首相拿督斯里安华宣布周一为假期，是根据1955年雇佣法令第60D(1)(b)条文、1951年公共假期法令第8条文宣布的有薪假期。
人力资源部今日发表文告称，雇主可以在周一当天准予员工休假，或者用其他任何一天作为员工的带薪公共假期。
雇主必须与员工讨论是选择 11 月28日作为公共假期，还是用其他日期作为替代假期。
雇主若没有给予员工替代假期，28日当天工作的员工将能享有公共假期的工资率。
所有在1951年假期法令第8条文所宣布的公共假期，都是11天加(Plus)1天，而不是归为11天内的公共假期。但是这只是有效于first scedule 的员工，即薪水低于RM2000.00以下的员工或manual labour才能自动享有。其他薪水阶层的员工，需要依据本身的雇用协议或公司的policy而定。
Notification under Section 8 gazetted on 25.11.2022 “IN exercise of the powers conferred by section 8 of the Holidays Act 1951 [Act 369], the Prime Minister appoints 28 November 2022 as a public holiday in Peninsular Malaysia, in addition to the days mentioned in the First Schedule of the Act.”
