381PC: 偷窃雇主财物

被告是某家油站的员工，他被控偷取及盗用存放在油站隶属大马皇家警队的添油卡。被告行为抵触刑事法典第381及403条文。
根据案情，上述添油卡是存放在油站的警察专用收藏袋。警员发现添油卡遗失后，翻查油站的闭路电视时发现被告从收藏袋偷走添油卡。
警方等至值夜班的员工出现后，便向对方进行搜查，结果在对方的背包搜出相关添油卡，当场将他逮。
另外被告偷窃和盗用上述的添油卡的行为，同时也触犯刑事法典第381（偷窃雇主财物）条文。一旦罪成，将判最高监禁7年及罚款。被告行为触犯刑事法典第403（不诚实地盗用财物）条文，可被判监禁半年至5年，另加鞭笞及罚款。
被告对2项控状俯首认罪，2项控罪分别监禁6个月，以及监禁6个月和1次鞭笞。不过，由于2项刑罚同时执行，因此被告仅需监禁6个月和1次鞭笞。

Penal Code

381 Theft by clerk or servant of property in possession of master

Whoever, being a clerk or servant, or being employed in the capacity of a clerk or servant, commits theft in respect of any property in the possession of his master or employer, shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to fine.

Theft after preparation made for causing death or hurt in order to commit theft.

403 Dishonest misappropriation of property

Whoever dishonestly misappropriates, or converts to his own use, or causes any other person to dispose of, any property, shall be punished with imprisonment for a term which shall not be less than six months and not more than five years and with whipping and shall also be liable to fine.
