员工申请被驳回，法庭强调60天时限的重要性

根据马来西亚工业关系法1967年第20(3)条款规定，员工如果认为自己被无理解雇，必须在被辞退后的60天内向工业法庭投诉无理解雇。然而当员工对解雇程序提出内部上诉，并且上诉被公司驳回时，这60天的时间限制是从上诉日开始算起，还是从一开始被辞退的日期算起？
员工是一位大学教授，她于2019年12月4日被大学辞退。她对此向大学提出内部上诉然而上诉被驳回。员工之后在隔年的3月9日（被辞退约3个月后），向劳资关系部门投诉了被无理解雇的情况。
但是，由于超过了60天的时限，人力资源部长拒绝将她的投诉提交给工业法庭。员工通过司法复核程序申请撤销部长的决定。
高庭指出，根据法案规定，必须严格遵守60天的时限，所以时间是从被辞退的日期开始算起。
解雇日期”指的是服务终止信中的终止日期，而不是任何内部上诉决定的日期 …the domestic appeal procedure
