儿童法令: 新闻媒体不得公布儿童的资料

1. 在各家报纸和新闻媒体频道之间的竞争日益激烈的情况下，儿童的权力似乎受到了侵犯。

2. 其实法律明确规定，新闻媒体不得公布有关的儿童的姓名，也不得公布他们的照片。不幸的是，我们见证了许多隐私泄露的情况，尤其是泄露了被指控遭受严重伤害、可能是强奸或其他虐待的儿童的信息。

3. 他们的个人信息通过众多新闻报道甚至更糟糕的是通过社交媒体传播开来。
4. 在2001年儿童法令的第2条文下，儿童指的是18岁以下的人。其实在这法令下，媒体在报道中是不可以透露涉及的儿童的姓名、地址、教育机构，或包含任何可能导致识别相关儿童的细节，无论是作为被采取行动的人或与行动有关的人，还是作为目击证人。
5. 日前我国一名在TikTok坐拥150万名粉丝的女教师，由于上载一个拍摄学生样貌的视频引起家长不满，质疑其举动不恰当。
6. 这名来自国际学校的女教师目前已迅速删除了所有与学生互动视频，其TikTok帐号内没有留下任何一则视频。
7. 身为教育工作者，其实更应该注重这方面的细节，不适当的在社没公布学生的照片/资料，对有关学生会造成很大的隐患。

Children Act 2001

31. Ill-treatment, neglect, abandonment or exposure of children

(1) any person who, being a person having the care of a child—

(a) abuses, neglects, abandons or exposes the child or acts negligently in a manner likely to cause him physical or emotional injury or causes or permits him to be so abused, neglected, abandoned or exposed; or

(b) sexually abuses the child or causes or permits him to be so abused, commits an offence and shall on conviction be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding twenty years or to both.

(2) The Court shall, in addition to any punishment specified in subsection (1), order the person convicted of an offence under that subsection—

(a) to execute a bond with sureties to be of good behavior for such period and on such conditions as the Court thinks fit; and

(b) to perform community service.
