31 CA: 保姆掌掴敲打男婴, 罚款10千+守行3年+120小时社服

1. 一名对11个月大男婴造成伤害的保姆，被法庭裁定罚款1万令吉。若被告无法缴付罚款，则需以18个月监禁代替，同时也需要守行3年，以及要从今日起的6个月内展开120个小时的社会服务。
2. 这名保姆涉嫌掌掴婴儿，并敲打其额头，直至造成擦伤和伤痕。
3. 根据控状，负责照顾男婴的被告，在受害者的住家对他造成伤害。
4. 被告的行为抵触2001年儿童法令第31(1)(a)条文(虐待、疏忽、遗弃或抛弃儿童)。一旦罪成，被告可被罚款最高50千令吉或监禁不超过20年，或两者兼施。在该法令下，罪成者亦可被谕令守行及进行社区服务。

31. Ill-treatment, neglect, abandonment or exposure of children

(1) Any person who, being a person having the care of a child—

(a) abuses, neglects, abandons or exposes the child or acts negligently in a manner likely to cause him physical or emotional injury or causes or permits him to be so abused, neglected, abandoned or exposed; or

(b) sexually abuses the child or causes or permits him to be so abused, commits an offence and shall on conviction be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding twenty years or to both.

(2) The Court shall, in addition to any punishment specified in subsection (1), order the person convicted of an offence under that subsection—

(a) to execute a bond with sureties to be of good behavior for such period and on such conditions as the Court thinks fit; and

(b) to perform community service.
