前夫不付孩子抚养费,前妻能不让他探望孩子?

问:

  1. 我和前夫离婚时,法庭命令两个孩子跟
  2. 我生活,前夫每月七日前必须支付RM1,800孩子抚养费,并承担一半学费和医药费。他也可以隔周周末接孩子过夜。离婚后的头三个月,他还有付款,之后便开始拖欠,最后完全没有汇钱,电话不接,信息也不回。学校已经催缴学费,房东也发出欠租通知,我只能向家人借钱,晚上再做兼职,才能让孩子继续上学。
  3. 前夫嘴里说没有钱,却换了新车、带女朋友旅行,还把照片放上社交媒体。到了探视日,他突然出现,坚持马上把孩子带走。我问他什么时候支付抚养费,他却说抚养费是抚养费,探视是探视,还警告我不交出孩子,就报警说我违反法庭庭令。他甚至发律师信,声称要申请藐视法庭、争取孩子抚养权,并要求我赔偿他的律师费。孩子在旁边听见我们争吵,一直问为什么爸爸有钱旅行,却没有钱买课本。
  4. 我已经连续几个月独自承担孩子的生活费,也担心前夫接走孩子后不按时送回来。请问,我能不能在他付清孩子抚养费之前,暂时停止让他探视?我能不能规定他先汇款,才可以接孩子?我要怎样追讨拖欠的抚养费、直接扣他的薪水、冻结银行户口或查封财产?如果我拒绝一次探视,他能不能用藐视法庭把我关起来,或者以此为理由抢走孩子的抚养权?

Question:

  1. When my former husband and I divorced, the Court ordered that our two children would live with me. He was required to pay RM1,800 in child maintenance by the seventh day of every month and bear half of their school and medical expenses. He was also given overnight access on alternate weekends. He paid for the first three months, then began paying late, and eventually stopped paying altogether. He no longer answers my calls or messages. The school is demanding payment of outstanding fees, my landlord has issued a rental reminder, and I have had to borrow money from relatives and work at night just to keep the children in school.
  2. My former husband says that he has no money, but he has bought another car, travelled with his girlfriend and posted the photographs on social media. On the latest access weekend, he suddenly appeared and demanded that I immediately hand over the children. When I asked when he would pay the maintenance arrears, he said that maintenance and access were separate matters. He threatened to make a police report if I refused to release the children. He later sent me a lawyer’s letter threatening contempt proceedings, an application to obtain custody and a claim for his legal costs. One of the children heard us arguing and asked why their father had money to travel but no money for schoolbooks.
  3. I have been paying all the children’s expenses alone for several months. I am also worried that my former husband will not return them at the agreed time. Can I temporarily stop his access until he pays all outstanding child maintenance? Can I impose a condition that he must first transfer the money before collecting the children? How do I recover the arrears, obtain a direct salary deduction, garnish his bank account or seize his property? If I refuse access on one occasion, can he have me committed for contempt of court or use the refusal to take custody of the children away from me?

答:

  1. 先讲结论:不能用孩子交换抚养费。 前夫不支付孩子抚养费,前妻不能自行停止法庭已经批准的探视权;同样地,前夫也不能因为前妻阻止探视,就停止支付抚养费。抚养费和探视权是两项独立的法律责任,任何一方都不能拿孩子当作追债、报复或谈判工具。本文讨论的是受《1976年法律改革(婚姻及离婚)法令》[Act 164]管辖的非穆斯林婚姻;穆斯林家庭案件必须根据各州伊斯兰家庭法处理。
  2. 为什么不能禁止探视? 根据《1976年法律改革(婚姻及离婚)法令》第89(2)(d)条,法庭可以规定没有取得孩子抚养权的一方,在合理的时间和频率探视孩子。与此同时,第92条及第93条规定,父母必须按照自己的经济能力和生活水平,为孩子提供住所、衣服、食物、教育和生活费用。法令把探视和抚养费分开规定,意思就是两者不能互相抵销。
  3. 法庭首先保护的是孩子。 第88(2)条规定,法庭决定抚养权和探视安排时,孩子的福利是首要考虑。法庭也会考虑父母的意见,以及年龄和理解能力足够的孩子本身的意愿。因此,法庭不会因为父亲欠钱,便自动切断孩子与父亲的关系;反过来,父亲也不能利用探视权逃避养育孩子的责任。
  4. 现有庭令必须照做。 只要探视庭令仍然有效,母亲便必须按照庭令交接孩子。若父亲有暴力、吸毒、酒后驾驶、企图带孩子出国或不归还孩子的证据,正确做法不是自行取消探视,而是立即根据第96条申请更改庭令,要求暂停探视、缩短时间、禁止过夜或安排监督探视。若有把孩子带离马来西亚的风险,还可根据第101条申请禁制令。
  5. 追讨抚养费先整理证据。 母亲应准备离婚庭令、逐月欠款表、银行月结单、学费及医药费单据、双方WhatsApp记录,以及父亲承认拖欠或拒绝付款的信息。欠款表必须清楚写明每个月应付多少、实际支付多少及余额多少。不要只告诉法庭“他欠了很多个月”,而是要让法庭一眼算出准确欠款。
  6. 最有效的执行方法不是不停催他。 母亲可回到作出抚养费庭令的法庭,要求确认欠款数额并展开执行程序。根据《1968年已婚妇女及儿童(抚养费执行)法令》[Act 356]第4条,法庭可发出薪金扣押令,命令雇主从父亲薪水中直接扣除抚养费。根据《2012年法庭规则》,母亲也可申请扣押银行户口、查封和拍卖财产、传召父亲申报资产、取得押记令,或采取其他判决执行程序。
  7. 不要让欠款拖过三年。 第98条把第86条的追讨规则应用于孩子抚养费,而第86(3)条限制通过诉讼追讨超过起诉日前三年累积的欠款。因此,父亲一旦持续欠款,母亲就应尽快采取行动,不要等孩子长大才一次追讨。Koay Cheng Eng v Linda Herawati Santoso [2008] 4 MLJ 863; [2008] 4 CLJ 105确认三年期限内的抚养费欠款可以追讨。
  8. 对付长期拖欠和转移财产。 如果父亲多次违约,母亲可根据第94条申请担保抚养费,例如要求提供财产或其他保障。如果父亲卖屋、转名或把资产交给亲属,以逃避抚养费,母亲可引用第102条要求法庭阻止或撤销为了逃避抚养责任而作出的财产处分。
  9. 欠钱不等于马上坐牢。 母亲可以申请藐视法庭,但必须证明庭令内容清楚、父亲知道庭令、他有能力付款却故意不服从。Lee Lay Ling v Goh Kim Nam (Cheah Pei Ching, Co-Respondent) [2013] 1 LNS 1000中,妻子要求因拖欠抚养费把丈夫判入狱,但法庭认为单纯没有支付金钱判决并不自动构成藐视,申请人也没有达到刑事标准证明丈夫故意违令,申请因此被驳回。这个败诉案例说明,薪金扣押、银行扣押和财产执行往往比只申请监禁更实际。
  10. 母亲因欠款要求取消探视,结果败诉。 在Ramakrishnan a/l Ramanaidu v Vikneswari a/p Selvaraj [2020] MLJU 491,母亲指父亲拖欠抚养费、没有照顾孩子并影响孩子生活,要求取消父亲的探视权。吉隆坡高庭裁定,没有证据证明出现足以取消探视的重大情况改变,并强调探视属于孩子的基本权利。母亲的申请被驳回,并须支付RM5,000堂费。
  11. 父亲申请扩大探视,结果获准。 在JOY v GIA [2023] MLJU 2846,高庭因孩子年龄增长及情况改变,批准父亲更广泛的探视安排和有限度的共同监护权。法庭清楚指出,探视绝不能以支付孩子抚养费为条件,也不能成为父母之间讨价还价的工具。这是目前处理“不付抚养费能否禁止探视”最直接的司法指引之一。
  12. 其他重要判例。 Leong Sam Moy v Low Chee Thiam [1997] 2 CLJ Supp 212及Celvambigai a/p S Thirucelvam v Pandian a/l Subramaniam [2015] MLJU 2093确认,探视首先是孩子与父母维持关系的权利。Sivajothi K Suppiah v Kunathasan Chelliah [2006] 3 MLJ 184; [2006] 5 CLJ 318确认,更改庭令必须证明重大的情况改变。较新的BEN v KEN [2025] MLJU 1819则显示,法庭可拒绝多年旧欠款的部分要求,却同时命令父亲支付未来每月抚养费、年度增加额及大学费用,并按孩子意愿安排有限探视。
  13. 法律与生活总结。 法律上,母亲必须继续遵守探视庭令,同时马上通过法庭追讨欠款、扣押薪金、冻结银行款项或执行财产;若孩子面对真实安全风险,则应紧急申请监督探视或更改庭令。生活上,双方应把金钱和亲子关系分开,交接孩子时不要争论欠款,不要让孩子传话,也不要在孩子面前攻击另一方。

Answer:

  1. The direct answer: a child cannot be exchanged for maintenance. Where a former husband fails to pay child maintenance, the former wife cannot unilaterally suspend access already granted by a Court order. Equally, the father cannot st
  2. op paying maintenance merely because the mother has obstructed access. Maintenance and access are separate legal obligations. Neither parent may use the child as a debt-collection device, punishment or bargaining tool. This article concerns non-Muslim civil marriages governed by the Law Reform (Marriage and Divorce) Act 1976 [Act 164]. Muslim family matters are governed by the applicable State Islamic family laws and the Syariah Courts.
  3. Why does non-payment not automatically terminate access? Under section 89(2)(d) of the Law Reform (Marriage and Divorce) Act 1976, the Court may provide for a parent who does not have custody to have access to the child at such times and with such frequency as the Court considers reasonable. Separately, sections 92 and 93 empower the Court to require a parent to provide accommodation, clothing, food and education for the child according to that parent’s means and position in life. Parliament dealt with access and maintenance in separate provisions. One obligation therefore cannot lawfully be set off against the other.
  4. The child’s welfare comes first. Under section 88(2), the welfare of the child is the paramount consideration when the Court decides custody and access. The Court may also consider the parents’ wishes and, where the child is old enough to express an independent view, the child’s wishes. The Court will not automatically sever a child’s relationship with the father merely because the father owes money. Conversely, the father cannot rely on his access rights as an excuse to avoid his financial responsibilities. The Court determines each issue by examining how the proposed order will affect the child.
  5. An existing Court order must be obeyed. So long as the access order remains in force, the mother must comply with its dates, times and handover arrangements. Where there is evidence of violence, drug abuse, intoxicated driving, threatened abduction or failure to return the child, the correct response is not unilateral cancellation. The mother should urgently apply under section 96 to vary the order by suspending overnight access, shortening access periods, requiring supervised access or imposing safeguards. If there is a genuine risk that the child will be removed from Malaysia, an injunction may be sought under section 101.
  6. Prepare the maintenance evidence properly. The mother should assemble the sealed divorce or maintenance order, a month-by-month arrears schedule, bank statements, school and medical invoices, proof of payments made for the children, and all relevant WhatsApp messages. The schedule should state the amount due, the amount received, the payment date and the outstanding balance for every month. A vague allegation that the father has “not paid for a long time” is inadequate. The Court and the enforcement officer should be able to identify the exact outstanding sum from the documents without reconstructing the account themselves.
  7. Use enforcement proceedings instead of repeated informal demands. The mother may return to the Court that made the maintenance order, obtain confirmation of the arrears and begin execution. Under section 4 of the Married Women and Children (Enforcement of Maintenance) Act 1968 [Act 356], an attachment of earnings order may require the father’s employer to deduct maintenance directly from his salary. Under the Rules of Court 2012 [P.U. (A) 205/2012], the available measures include garnishee proceedings against bank accounts, a writ of seizure and sale, examination of the judgment debtor regarding his assets and income, and a charging order over property or securities.
  8. Do not allow arrears to remain unattended for more than three years. Section 98 applies the enforcement provisions in section 86 to child maintenance. Under section 86(3), arrears that accrued more than three years before the commencement of the suit cannot be recovered through that suit. A mother should therefore act when the default becomes persistent, rather than waiting until the child reaches adulthood. In Koay Cheng Eng v Linda Herawati Santoso [2008] 4 MLJ 863; [2008] 4 CLJ 105; [2008] MLJU 113, the Court of Appeal upheld the recovery of maintenance arrears falling within the statutory three-year period.
  9. Persistent default and concealment of assets require stronger orders. Under section 94, the Court may require security for maintenance. This is useful where a payer has repeatedly defaulted or has irregular income. If the father attempts to sell, transfer or place assets in the names of relatives to defeat the maintenance obligation, section 102 empowers the Court to restrain or set aside a disposition made with the object of reducing his ability to pay maintenance. The mother should preserve land searches, company searches, vehicle information, sale advertisements and messages concerning any intended transfer.
  10. Failure to pay does not automatically result in imprisonment. Committal proceedings require proof that the order was clear, the father knew about it, he had the ability to comply and he deliberately refused to do so. In Lee Lay Ling v Goh Kim Nam (Cheah Pei Ching, Co-Respondent) [2013] 1 LNS 1000, the wife sought to have the husband committed for failure to pay maintenance and other sums. The Court dismissed the application because non-payment of a monetary order did not by itself establish contempt, and wilful disobedience had not been proved beyond reasonable doubt. The decision demonstrates why salary attachment, garnishment and asset execution are often more productive than relying solely on committal.
  11. A mother who sought to cancel access because of arrears lost her application. In Ramakrishnan a/l Ramanaidu v Vikneswari a/p Selvaraj [2020] MLJU 491, the mother alleged that the father had failed to pay maintenance, had not properly cared for the children and had disrupted their lives. She applied to terminate his access. The Kuala Lumpur High Court held that the evidence did not establish a material change of circumstances sufficient to cancel access. The Court emphasised that access was a basic right belonging to the children, dismissed the mother’s application and ordered her to pay RM5,000 in costs.
  12. A father who applied for enhanced access succeeded. In JOY v GIA [2023] MLJU 2846, the High Court found that the children’s increased ages and the changed family circumstances justified enhanced access and limited joint guardianship in favour of the father. The Court expressly stated that access must never be made contingent upon the payment of child maintenance and must not be used as a bargaining tool. The case provides direct guidance for disputes in which one parent seeks to withhold the child until maintenance is paid. The mother’s legal remedy is enforcement of the maintenance order, not self-imposed suspension of access.
  13. Other important Malaysian authorities support the same approach. Leong Sam Moy v Low Chee Thiam [1997] 2 CLJ Supp 212; [1996] MLJU 640 recognised access as a basic right of the child rather than a privilege belonging solely to the parent. Celvambigai a/p S Thirucelvam v Pandian a/l Subramaniam [2015] MLJU 2093 stressed the value of children spending quality time with both parents. Sivajothi K Suppiah v Kunathasan Chelliah [2006] 3 MLJ 184; [2006] 5 CLJ 318; [2006] MLJU 21 confirmed that a variation under section 96 requires a material change of circumstances. In BEN v KEN [2025] MLJU 1819, the Court rejected parts of an eight-year arrears claim but ordered RM2,500 monthly future maintenance, annual increases, a contribution towards university expenses and limited access subject to the teenage child’s wishes. The mixed result shows that arrears, future maintenance and access are decided separately.
  14. Legal and practical conclusion. Legally, the mother must continue complying with the access order while immediately pursuing arrears through salary attachment, garnishment, seizure of assets or other Court enforcement. Where the child faces a proven safety risk, she should seek an urgent variation, supervised access or an injunction instead of taking the law into her own hands. Practically, the parents should keep financial disputes away from collection and handover arrangements, communicate through one written channel, avoid using the child as a messenger and never criticise the other parent in the child’s presence.
