498 PC: 蓄意使人妻与任何人进行非法性交-02.04.2019

男被告 (丈夫) 带小三回家发生性关系。女被告 (太太) 在家发现他们的好事并争吵了起来。
女被告因为男被告与小三发生性关系，突然用刀子刺伤受害者的私处。小三惊叫下，女被告逃离，并把刀子丢在屋外。
女被告因使用危险武器严重伤人，抵触刑事法典第326条文。一旦罪成将被判监不超过20年监禁和罚款或者打鞭。
女被告被判坐牢8年，刑期从被捕日算起。
男被告因抵触刑事法典第498条文，并被控上庭。
根据刑事法典第498条文，任何人知道或有理由相信一妇女已是他人妻，而从该人带走或拐带该妇女，蓄意使她与任何人进行非法性交，或怀有该项意图，或扣留该妇女，一旦罪成，将会判处不超过2年监禁，或罚款，或两者兼施。
案发当天，被告明知受害者已婚，有4名孩子，丈夫在外地工作，仍与受害者交往，甚至发生性关系。地方庭判处男被告坐牢7个月。

Penal Code

326.Voluntarily causing grievous hurt by dangerous weapons or means

Whoever, except in the case provided by Section 335, voluntarily causes grievous hurt by means of any instrument for shooting, stabbing or cutting, or any instrument which, used as a weapon of offence, is likely to cause death, or any scheduled weapon as specified under the Corrosive and Explosive Substances and Offensive Weapons Act 1958, or by means of fire or any heated substance, or by means of any poison or any corrosive substance, or by means of any explosive substance, or by means of any substance which it is deleterious to the human body to inhale, to swallow, or to receive into the blood, or by means of any animal, shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable to fine or to whipping.

498.Enticing or taking away or detaining with a criminal intent a married woman

Whoever takes or entices away any woman who is and whom he knows, or has reason to believe, to be the wife of any other man, from that man, or from any person having the care of her on behalf of that man, with intent that she may have illicit intercourse with any person, or conceals, or detains with that intent any such woman, shall be punished with imprisonment for a term which may extend to two years, or with fine, or with both.
