- 我跟太太已经分居很久,之前大家坐下来谈好离婚条件,孩子、产业、赡养费、银行贷款、车子、保险、家具,全部都写进联名离婚申请书。她也签了文件,也签了 affidavit。我们还一起去律师楼确认过,她当时亲口说同意离婚,不会再拖。我以为这件事终于可以结束,所以我开始安排自己的生活,通知家人,安排工作请假,也准备在离婚后处理房屋贷款和孩子探视。
- 哪里知道开庭前几天,她突然变脸。她说她后悔了,不要离婚了,也不要出庭。她还说之前签的文件不算,因为她现在不同意。最让我崩溃的是,她还叫我继续供屋子、继续给钱、继续负责孩子费用,可是她又不愿意让离婚继续。她的信息一时说要我加钱,一时说要改孩子抚养权,一时又说如果我不同意她的新条件,她就直接不去法庭,让整个离婚案卡死。
- 我现在真的很无助。我已经花了律师费,文件也进了法庭,听审日期也排了。她之前明明签了联名离婚申请,现在临时反悔,还说她可以撤回同意。请问在马来西亚,联名离婚是不是只要签了就不能反悔?如果她开庭当天不出现,法庭还可以继续批准离婚吗?她签了 affidavit 后又撤回 consent,法庭会不会照样判离婚?我可以怎样保护自己,不让她用离婚案来逼我给更多钱?

- My wife and I have been separated for a long time. We previously sat down and agreed on all the divorce terms, including the children, matrimonial property, maintenance, bank loan, car, insurance and household items. Everything was put into a joint divorce petition. She signed the petition and the affidavit. We even went to the solicitor’s office together, and she personally confirmed that she agreed to the divorce and would not delay the matter. I thought everything was finally ending, so I arranged my work leave, informed my family and started planning how to deal with the housing loan and access to the children after the divorce.
- A few days before the court hearing, she suddenly changed her mind. She said she regretted it, refused to divorce and refused to attend court. She also said the documents she had signed no longer counted because she no longer agreed. What makes me feel trapped is that she still wants me to continue paying the house loan, continue giving money and continue bearing the children’s expenses, but she refuses to let the divorce proceed. Sometimes she demands more money, sometimes she wants to change the custody terms, and sometimes she threatens that if I do not agree to her new conditions, she will simply not attend court and let the whole divorce case collapse.
- I am now helpless. I have paid legal fees, the documents have been filed in court, and the hearing date has been fixed. She clearly signed the joint divorce petition, but now she says she can withdraw her consent. Under Malaysian law, once a joint divorce petition is signed, can one party still change his or her mind? If she does not appear in court on the hearing date, can the court still approve the divorce? If she signed an affidavit but withdraws consent before the decree is pronounced, will the court still proceed? What can I do to protect myself from being pressured into paying more money just because she is using the divorce case as leverage?

联名离婚不是“签了就一定离”
- 在马来西亚,非穆斯林离婚主要受 Law Reform (Marriage and Divorce) Act 1976 / 法律改革(婚姻与离婚)法令1976 约束。联名离婚是根据 section 52 提出,核心不是“双方曾经签过”,而是法庭在批准离婚时必须满意双方是自由同意离婚,并且妻子、孩子的赡养、照顾、抚养和产业安排是妥当的。换句话说,联名离婚的 consent 不是只看签文件那一天,而是要看开庭当天,法官是否还能确认双方仍然同意。Sivanesan v Shymala [1986] 1 MLJ 400 清楚说明,section 52 要求法庭满意双方 freely consent,而且法庭可以向双方发问,确认他们是否真的明白和同意离婚后果。
一方开庭前反悔,法庭不能把联名离婚当成普通程序硬推过去
- 最直接的案例是 Re Goh Hoe Ling & Anor [1996] 1 MLJ 137。案中,夫妻签了 separation deed,也在文件里写明双方同意离婚,后来也 filed joint petition。可是妻子过后 filed notice of discontinuance 和 notice of withdrawal of consent。丈夫反对,说她已经签了 agreement,不可以反悔。高庭不接受这种说法。法庭裁定,决定双方是否 freely consent 的关键时间,是 hearing date,不是签文件那一天。妻子既然在开庭前撤回同意,法律上就等于她已经撤回之前给过的 consent,联名离婚申请应被 struck off,双方可重新 filed afresh。
为什么法庭这么重视双方亲自出庭?
- 原因很简单:联名离婚不是普通商业合约。离婚会改变婚姻身份、孩子安排、赡养费、产业分配、未来再婚资格和家庭责任。Sivanesan v Shymala [1986] 1 MLJ 400 说明,petitioners must appear in court,因为法庭可能要亲自问双方:你是不是自由同意离婚?你是不是明白产业和赡养安排?孩子安排是不是公平?Re Goh Hoe Ling & Anor [1996] 1 MLJ 137 也跟随这个原则,强调 joint petition 里双方必须 physically present in court,让法庭满意他们仍然 freely consent。
实务上的确定答案:反悔后,联名离婚路线走不下去
- 如果一方在 decree nisi 还没有 pronouncement 之前,明确撤回 consent、拒绝出庭、或在法庭面前说“我不同意离婚”,法庭不应继续以 section 52 联名离婚方式批准离婚。正确做法是:第一,申请 adjourn 或 strike off joint petition;第二,记录对方撤回 consent 的事实;第三,若婚姻确实已经破裂,另一方应改走 single petition,即根据 sections 53 and 54 of the Law Reform (Marriage and Divorce) Act 1976,以婚姻 irretrievably broken down 为理由提出单方面离婚申请;第四,重新处理孩子、赡养、产业分配和 costs。联名离婚的基础是 mutual consent,一旦 mutual consent 消失,section 52 的法律基础就消失。
但是,签过的协议不一定完全没用
- 虽然撤回 consent 后,法庭不能强行把联名离婚批准掉,但之前签过的 separation agreement、WhatsApp 讯息、草拟条件、财务安排、孩子安排、付款记录和 affidavit,仍然有证据价值。它们可以用来证明双方曾经怎样谈判、谁后来反口、谁提出不合理条件、谁拖延程序、谁用孩子或钱来施压。Ong Ah Mai v Ling Pooi Ming [1984] 2 MLJ 129 在 Re Goh Hoe Ling 中被引用,说明法庭在 hearing joint petition 时要看双方同意的 provision 是否 proper。换句话说,协议本身不是自动变成 divorce order;它必须经过法庭检查和批准,才会成为有约束力的离婚命令。
如果 decree nisi 已经出了,情况就完全不同
- 开庭前反悔,和 decree nisi 后反悔,是两回事。Ng Boon Chwee & Anor [2018] MLJU 737 是一个很实用的案例。案中,夫妻 filed joint divorce petition,双方出庭,法庭满意他们明白申请内容并自由同意,之后 granted decree nisi。三个月期满后,他们和好,想撤销 decree nisi。高庭驳回申请,并说明 section 61(2)(b) 针对的是 section 53 单方面离婚,不适用于 section 52 联名离婚取得的 decree nisi。法庭也强调 decree nisi 期满后的 finality。这个案例告诉我们:如果要反悔,必须在 decree nisi pronouncement 之前清楚处理;等到 decree nisi 甚至 decree absolute 后,难度大幅提高。
decree absolute 后,不要以为一句“我后悔”就能翻案
- Wong Cheng Ping v Chin Guan Seng @ Tan Guan Seng [2010] 10 CLJ 743 支持一个重要原则:decree nisi 一旦成为 decree absolute,就不能轻易 set aside,除非有非常强的理由,例如 fraud、illegality、lack of jurisdiction 或严重程序缺陷。Re Yamamoto Ryoji & Anor [2021] 8 MLJ 386; [2020] MLJU 1137 则说明,若马来西亚法庭本来没有 jurisdiction,例如 domicile 问题有缺陷,双方 consent 也不能补救 jurisdiction 的问题。这个案虽然不是“反悔 consent”的直接案例,但它提醒大家:离婚 order 的有效性,除了 consent,还要看法庭有没有管辖权。
孩子、产业和赡养条款必须写清楚,不能靠模糊 affidavit 补洞
- Sivanesan v Shymala [1986] 1 MLJ 400 是经典案例,因为里面的问题不是一方反悔,而是 joint petition 和 affidavit 对产业安排写得混乱。Federal Court set aside decree nisi,并说明在 terms and conditions 没有 settle 和没有清楚写进 joint petition 或 amended joint petition 之前,法庭不应批准 mutual divorce。这个原则非常重要:联名离婚文件不能只是写“双方同意离婚”。必须清楚写明孩子 custody、care and control、access、maintenance、教育费、医疗费、产业、债务、EPF、保险、车贷、房贷、costs 和 liberty to apply。
实际解决方案:不要被对方用反悔来勒索
- 如果对方临时反悔,第一步是马上通过律师发正式 letter,要求对方确认是否仍同意 joint petition、是否出庭、是否撤回 consent。第二步,在 hearing 前通知对方及其律师,若她无合理理由拒绝出庭或临时加码,将在 costs 上追究。第三步,准备 affidavit 记录整个谈判过程,包括签署文件、付款、同意条件、突然反悔的信息和她的新要求。第四步,出庭时向法庭说明 section 52 的 mutual consent 已不存在,请求适当 order,包括 strike off with liberty to file afresh、costs reserved 或 costs in the cause。第五步,立刻准备 single petition,不要让对方长期卡住你的人生。第六步,如果有孩子、产业或金钱被对方拿来施压,应同步申请 interim custody、maintenance、injunction、preservation order 或 discovery。
相关后续案例:离婚 order 出了以后,不能随便改口
- LCY v TWY [2019] 4 MLJ 203 涉及 joint petition 后 decree nisi、conversion、孩子 custody 和 matrimonial assets 的复杂争议,说明在 decree absolute 前,如出现重要法律变化,法庭仍可处理和 set aside 相关 decree nisi。MEN v TEN [2024] CLJU 842 则涉及 joint petition 后 consent order 的 variation,法庭强调离婚 consent order 已经成为 court order,日后要更改 custody 或 maintenance,必须走正确法定路线,例如 section 96 或相关条文,而不是一句“我现在不满意”就能推翻。
总结
- 法律上,联名离婚的核心是持续存在的 mutual consent。签名、affidavit、separation agreement 和 WhatsApp 同意,不等于法庭一定批准离婚。一方在 decree nisi pronouncement 之前撤回 consent,法庭不应继续以 section 52 方式批准联名离婚;另一方应果断转去 single petition,并保留证据追讨 costs 和保护孩子、产业与金钱权益。生活上,不要在离婚未完成前轻信口头承诺,不要先私下付款买平安,不要把孩子、房屋和银行贷款安排写得模糊。所有条件必须写进正式文件,并且在开庭前再次确认对方仍然同意。

A joint divorce is not automatically final just because both parties signed.
- In Malaysia, non-Muslim divorce is governed principally by the Law Reform (Marriage and Divorce) Act 1976. A joint divorce petition is filed under section 52, but the real legal foundation is not merely the signature on the petition or affidavit. The court must be satisfied that both parties freely consent to the dissolution of marriage and that proper provision has been made for the wife and the support, care and custody of the children. In Sivanesan v Shymala [1986] 1 MLJ 400, the Federal Court made it clear that section 52 requires real consent and proper terms before the court grants a mutual divorce.
If one party withdraws consent before the hearing, the joint petition cannot be pushed through as if nothing happened.
- The most direct authority is Re Goh Hoe Ling & Anor [1996] 1 MLJ 137. In that case, the parties had signed a deed of separation stating that they mutually agreed to dissolve the marriage and freely consented to it. A joint petition was then filed. The wife later filed a notice of discontinuance and a notice withdrawing her consent. The husband argued that she was bound by the earlier deed and consent. The High Court rejected that argument. The court held that the material time for determining whether both parties freely consent is the date of hearing, not merely the date of signing. Since the wife had withdrawn her consent before the decree was granted, the joint petition was struck off, with liberty to file afresh.
Why does personal attendance matter in a joint divorce?
- The reason is practical and legal. Divorce changes marital status, children’s arrangements, maintenance obligations, matrimonial property rights and the parties’ ability to remarry. In Sivanesan v Shymala [1986] 1 MLJ 400, the Federal Court stated that petitioners must appear in court because the court may wish to question them to satisfy itself that they freely consent and that the provisions for the wife and children are fair and reasonable. Re Goh Hoe Ling & Anor [1996] 1 MLJ 137 followed that approach and emphasised that both petitioners in a joint petition should be physically present in court so the judge can be satisfied that their consent remains real and free.
The clear practical answer: once consent disappears, the section 52 route collapses
- Where one party withdraws consent, refuses to attend court or tells the court before pronouncement of decree nisi that he or she no longer agrees, the court should not proceed to grant a divorce under section 52. The correct course is to seek an adjournment or have the joint petition struck off, record the withdrawal of consent, and if the marriage has truly broken down, proceed by way of a single petition under sections 53 and 54 of the Law Reform (Marriage and Divorce) Act 1976. Once mutual consent no longer exists, the legal basis of a joint petition is gone.
The earlier signed agreement may still be useful evidence
- Although the court should not force a joint divorce through after consent is withdrawn, the earlier signed separation agreement, WhatsApp messages, draft terms, financial records, child arrangements and affidavits are not useless. They can prove the history of negotiation, the agreed terms, who later changed position, who made unreasonable demands and who caused delay. Ong Ah Mai v Ling Pooi Ming [1984] 2 MLJ 129, cited in Re Goh Hoe Ling, supports the principle that the court examines whether the provisions agreed by the parties are proper at the hearing of the joint petition. An agreement is therefore not automatically a divorce order; it becomes enforceable in the matrimonial sense only when the court accepts and embodies it into the decree or order.
After decree nisi, the legal position changes drastically
- There is a major difference between withdrawal of consent before decree nisi and regret after decree nisi. Ng Boon Chwee & Anor [2018] MLJU 737 is an important post-2010 case. The parties filed a joint petition under section 52, both appeared in open court, and the court was satisfied that they understood the prayers and freely consented. Decree nisi was granted. After the three-month period expired, they reconciled and applied to rescind the decree nisi. The High Court dismissed the application and held that section 61(2)(b) applies to a decree nisi granted under section 53, not to a decree nisi obtained through a section 52 joint petition. This case is a warning: if a party intends to withdraw consent, the issue must be raised before the decree is pronounced.
After decree absolute, regret is not enough
- Wong Cheng Ping v Chin Guan Seng @ Tan Guan Seng [2010] 10 CLJ 743 supports the principle that once decree nisi has become absolute, it is not lightly set aside except on strong grounds such as fraud, illegality, lack of jurisdiction or serious procedural defect. Re Yamamoto Ryoji & Anor [2021] 8 MLJ 386; [2020] MLJU 1137 is also useful because it shows that where the Malaysian court lacks jurisdiction, for example due to domicile issues, parties’ consent cannot cure that jurisdictional defect. Although Yamamoto is not a withdrawal-of-consent case, it confirms that a valid divorce order requires more than signatures and consent; jurisdiction must also exist.
Children, property and maintenance terms must be clear
- Sivanesan v Shymala [1986] 1 MLJ 400 remains essential because the Federal Court set aside a decree nisi where the terms relating to property were unclear and not properly settled in the joint petition. The court stated that until the terms and conditions are agreed, settled and incorporated into the joint petition or amended joint petition, the court should not grant a mutual divorce. This principle applies with full force to modern divorce drafting. A joint petition must clearly state custody, care and control, access, maintenance, education expenses, medical expenses, matrimonial property, debts, EPF, insurance, cars, housing loans, costs and liberty to apply.
Practical steps when one spouse uses last-minute withdrawal as pressure
- The innocent party should act immediately. First, issue a formal letter requiring the other spouse to confirm whether consent remains and whether he or she will attend court. Second, warn that unreasonable refusal to attend or last-minute financial demands will be raised on costs. Third, prepare an affidavit exhibiting the signed petition, affidavits, messages, agreed terms, payment records and the sudden withdrawal. Fourth, at the hearing, inform the court that mutual consent no longer exists and seek the appropriate order, including striking off with liberty to file afresh and costs reserved. Fifth, prepare a single petition without delay. Sixth, where children, money or property are being used as leverage, apply for interim custody, maintenance, injunction, preservation order or discovery.
Newer related cases confirm finality and proper procedure
- LCY v TWY [2019] 4 MLJ 203 involved a joint petition, decree nisi, conversion, custody and matrimonial assets. It shows that before decree absolute, the court can still address serious legal developments affecting the decree. MEN v TEN [2024] CLJU 842 involved variation of a consent order after a joint petition and decree absolute. The court treated the consent order as a court order and required the correct statutory basis for variation, including section 96 where applicable. The practical lesson is clear: before the decree, consent and terms must be clean; after the decree, parties must use the correct statutory machinery and cannot simply undo a court order because they are dissatisfied.

- Legally, the heart of a joint divorce is continuing mutual consent. A signature, affidavit, separation agreement or WhatsApp confirmation does not guarantee that the court will grant a divorce if consent is withdrawn before decree nisi is pronounced. Once one party withdraws consent before pronouncement, the joint petition should not proceed under section 52, and the other spouse should move decisively to a single petition while preserving evidence for costs, custody, maintenance and property protection. Practically, parties should never rely on vague verbal promises, should not pay extra money merely to “buy peace”, and should ensure that all agreed terms are recorded clearly in formal documents before the hearing.
