- In the Matter of Lau Hieng Yee, a Bankrupt [2000] 1 MLJ 59(胜):破产者向高庭申请从1998年至2003年期间出国,破产局一方先反对他未经同意聘请律师及采用有关申请程序。

Can an undischarged bankrupt leave Malaysia?
- Yes, but only after obtaining permission. Until permission is granted, the bankrupt must not leave Malaysia. Under section 38(1)(c) of the Insolvency Act 1967, an undischarged bankrupt requires prior permission from either the Director General of Insolvency (“DGI”) or the Court. Paying monthly instalments on time, having an adult child sponsor the entire trip, having a valid passport, or travelling only for a few days does not create an automatic exemption. A child’s overseas wedding, the death or serious illness of a close family member, genuine overseas employment, medical treatment and other reasonable personal matters provide substantially stronger grounds. MdI’s present electronic system expressly shows purposes such as attending the wedding of a child or close relative and visiting a sick or deceased family member. A purely recreational holiday, even when fully paid for by a child, is not a statutory exception.
Regular monthly payments help the application, but they do not replace permission.
- This distinction is important. The BHEUU Annual Report 2024 states that an overseas-travel application cannot be made through the system where the bankrupt has no relevant Statement of Affairs or instalment information, and it likewise cannot proceed where instalment payments are in arrears. Accordingly, a good payment record is not a “special exemption”; it is evidence of compliance and cooperation. MdI’s current bankruptcy FAQ also states that the DGI considers both the strength of the reason for travel and the bankrupt’s compliance record. A bankrupt who has kept his administration, income information and instalments up to date therefore starts from a materially stronger position than one who has ignored MdI for years.
The statutory restriction is serious
- Sections 38(1A), 38(2) and 38A of the Insolvency Act 1967 must be read together with section 38(1)(c). Under section 38(1A), the DGI or Court may impose conditions when granting permission. Under section 38(2), breach of section 38 or a condition attached to the permission may amount to contempt of court. Under sections 38A(1)–(3), the DGI may request Immigration to prevent the bankrupt from leaving Malaysia, and an immigration officer is empowered to seize the passport or travel document of a bankrupt attempting to leave without prior permission. It is therefore inaccurate to say that every bankrupt automatically “has no passport”. The legal point is different: possessing a passport does not by itself confer permission to use it to leave Malaysia.
How to apply in 2026, where is the form, and how long does it take?
- The present practical route is MdI’s e-Insolvensi – Permohonan Ke Luar Negara e-Insolvensi overseas travel application The applicant enters the purpose and precise travel period, followed by information concerning the bankruptcy, countries to be visited, passport, employment, sponsor, and six months’ income and expenditure, together with supporting documents. The current official guide states that the application must be lodged at least seven working days before departure. It further states that a complete application will be processed within three working days, after which the result may be checked through the portal or email. Three working days therefore refers to processing of a complete application; it does not mean that the bankrupt should wait until three days before the flight. The current online system and the MdI branch administering the bankruptcy should be followed instead of relying on old paper-form procedures, photographs, utility bills or historical processing periods found in older articles. (e-Insolvensi) Official MdI overseas travel user guide
- The evidence must match the real reason for travelling. For a child’s overseas wedding, a properly prepared application should include the wedding invitation, evidence of the parent-child relationship, venue and dates, travel itinerary and accommodation, together with the child’s sponsorship letter and evidence showing that the child genuinely bears the expenses. For a funeral or serious illness, the death certificate, funeral notice or hospital documentation and evidence of relationship should be supplied. The present portal expressly collects details of the sponsor, so third-party sponsorship is contemplated by the system. Sponsorship, however, only answers the question “who is paying?” It does not convert an ordinary holiday into a special legal entitlement. Historical official MdI administrative reports specifically recorded purely social or recreational travel with no benefit to the bankruptcy estate as a ground for refusal. An applicant should therefore never disguise tourism as a wedding, family emergency or employment application. False information creates a much more serious problem than the original travel restriction.
Can a bankrupt work overseas for years, and is a security deposit required?
- A bankrupt may apply to work overseas. The current e-Insolvensi form specifically states that the employment section is compulsory where the purpose of the application is employment. A proper long-term employment application should therefore include the employment offer or contract, employer’s particulars, salary, overseas address, work visa or permit and the contractual employment period. It should also explain how monthly insolvency contributions and six-month income and expenditure reporting will continue while the bankrupt remains overseas. Neither section 38 nor the present MdI guide creates a universal maximum of 30 days, 90 days, one year, two years or five years. The legally relevant period is the period actually approved by the DGI or Court. Likewise, there is no universal statutory “travel deposit” applicable to every bankrupt. The portal displays the relevant Bayaran Kredit Estet, and the payment function becomes available for an approved application; section 38(1A) separately allows further conditions to be imposed. The applicant must comply with the dates and conditions in the approval and return by the approved date unless an extension is separately obtained.
- DGI approval is not necessarily the only travel restriction that must be cleared. The declaration contained in the e-Insolvensi application expressly warns that restrictions arising from LHDN/HASiL, KWSP or PTPTN may continue even after the DGI approves the insolvency application. HASiL’s current 2026 guidance, for example, has its own procedure and financial conditions for temporary release from a tax travel restriction. A prudent applicant should therefore check the Malaysian Immigration Department’s SSPI travel-status system before departure. Travel from Peninsular Malaysia to Sabah or Sarawak also needs to be stated correctly. It is domestic travel and does not amount to “leaving Malaysia” for section 38(1)(c), but Sabah and Sarawak retain separate immigration controls. Immigration currently provides a substitute travel document for eligible Peninsular Malaysians visiting Sabah or Sarawak for social or business purposes for not more than three months, while longer stays involve a different restricted travel document. The old statement that a bankrupt can travel to East Malaysia with “no immigration problem at all” should therefore no longer be repeated.
What have the Malaysian courts decided?
- In the Matter of Lau Hieng Yee, a Bankrupt [2000] 1 MLJ 59 — procedural win for the bankrupt. The bankrupt sought permission from the High Court to travel overseas for a period stated as December 1998 to November 2003. The Official Assignee raised preliminary objections concerning the bankrupt’s ability to engage a solicitor and the procedure adopted. The High Court rejected those objections. Importantly, the Court held that nothing in section 38(1)(c) required the bankrupt first to obtain the Official Assignee’s sanction before applying to the Court for permission to leave Malaysia, and that the passport did not vest in the Official Assignee as bankruptcy property. The reported decision, however, dealt with those preliminary procedural objections; it should not be misquoted as authority that every bankrupt is entitled to a five-year travel approval.
- Lim Moon Heng @ Lim Boon Siang v The Government of Malaysia & Anor [2002] 2 MLJ 499; [2002] 2 CLJ 659 — bankrupt lost. Although the bankrupt had obtained permission from the bankruptcy authority and furnished a RM50,000 bank guarantee, the Inland Revenue authorities separately relied on section 104 of the Income Tax Act 1967 to restrict his travel. The High Court held that the tax authority’s statutory power remained independent; insolvency permission did not neutralise the tax restriction.
- Tai Choi Yu v Government of Malaysia & Ors [1994] 1 MLJ 677 — taxpayer lost. The Supreme Court upheld the statutory operation of the section 104 tax travel restriction. Together, these authorities establish the practical rule: a bankrupt may apply to the DGI or Court and may be legally represented, but every separate statutory travel restriction must also be cleared.
Conclusion
- The practical conclusion is straightforward. A child’s wedding, funeral, serious family matter and genuine overseas employment provide identifiable grounds for an application. A child paying for the trip establishes the source of funds but does not create an automatic exemption. Regular instalment payments are important evidence of compliance but do not themselves confer a right to travel. There is no statutory universal maximum duration for overseas employment, and there is no fixed travel security applicable to every bankrupt. If an administrative application cannot secure the permission or duration genuinely required, section 38(1)(c) preserves the route of applying to the Court, and Lau Hieng Yee confirms that prior DGI sanction is not a prerequisite merely to approach the Court. Its old procedural rules, however, should not be copied mechanically because the present regime includes the Insolvency Rules 2017.
- What is truly expensive is never the consultation fee but the wrong decision made to save it. In a bankruptcy travel matter, a careless explanation, incomplete financial record, undisclosed restriction or wrongly structured application can destroy an otherwise workable case.
