Question:
- I rented out my house to a tenant for about two years, but the TNB electricity account remained unchanged. I did not live at the property and had never touched the electricity meter. Shortly after the tenant moved out, TNB officers suddenly came to inspect the premises. I was not informed beforehand, nobody representing me was present, and I did not witness what they did. When they left, all I found was a notice saying that there was an irregularity involving the meter. A few weeks later, I received another letter saying that the meter installation had allegedly been tampered with and that electricity had been under-recorded for almost two years. TNB demanded more than RM12,000 from me.
- I could not understand how I suddenly became responsible for “electricity theft”. I never tampered with the meter and I do not know whether my former tenant did anything to it. The tenant has already moved away and no longer answers my calls. What makes matters worse is that throughout those two years, TNB itself issued monthly bills and I paid every bill presented to me. Now TNB says those bills were wrong and wants to go backwards for two years and charge me another RM12,000.
- I asked TNB to show me exactly what had been tampered with, when the alleged tampering started, what evidence proved the two-year period and how RM12,000 was calculated. Instead, I received technical figures that an ordinary consumer would hardly understand. Can TNB inspect the meter, decide that tampering occurred, calculate its own loss and then expect me simply to pay? Where can I appeal? Can I complain to the Energy Commission? Does TNB need to notify me before inspecting the meter? If my tenant was responsible, why should I pay? Can TNB legally back-charge two years? Can I demand a reduction, recalculation or instalment plan? Most importantly, if TNB refuses to reconsider the claim, can I challenge its evidence and calculation in court?
Tenaga Nasional Bhd v Evergrowth Aquaculture Sdn Bhd and other appeals [2021] 5 MLJ 937 (FC)
Tenaga Nasional Bhd v Ichi-Ban Plastic (M) Sdn Bhd and other appeals [2018] 3 MLJ 141; [2018] 3 CLJ 557 (FC)
- 2026年的 Lim Keem Kok & Sons Realty Sdn Bhd v Tenaga Nasional Berhad, High Court Civil Appeal No. MA-12BNCvC-1-02/2026 (9.7.2026) 更值得屋主注意。
Answer:
- A TNB meter-tampering claim can be appealed, disputed and challenged. A demand for RM12,000 does not become unquestionable merely because TNB calculated it. The consumer should immediately lodge a written objection without admitting liability, demand the supporting evidence and calculation, and request a negotiation or appeal before TNB’s Jawatankuasa Khas Usikan Meter. If the matter is not satisfactorily resolved by TNB, the next regulatory complaint should be made to the Energy Commission, Suruhanjaya Tenaga (“ST”). I would not advise a consumer to sign an admission, accept responsibility for electricity theft or make a disputed lump-sum settlement merely because a demand has arrived.
A two-year retrospective claim deserves immediate legal scrutiny
- Under section 38(3) of the Electricity Supply Act 1990 [Act 447], TNB may recover loss of revenue caused by offences falling within the specified provisions of section 37, together with permitted expenses. However, section 38(3) contains an important proviso: where the licensee does not proceed with its claim in court, the retrospective period is limited to no more than six months from discovery of the offence. ST’s own official Loss of Revenue Claim Procedure Guide says expressly that where the period exceeds six months, the claim must proceed through the court process. A two-year computation is therefore not an administrative figure which the consumer is legally prohibited from disputing. If TNB insists on recovering beyond six months, it must be prepared to establish that claim judicially.
The first legal question is whether this is an ordinary faulty-meter case or an allegation of fraudulent meter tampering
- This distinction is critical. The Licensee Supply (Amendment) Regulations 2025, P.U.(A) 335/2025, which came into force on 1 October 2025, amended regulation 11. For ordinary undercharging caused by matters such as meter inaccuracy, malfunction, incorrect reading, incorrect billing, faulty meter installation or smart-meter communication failure, retrospective adjustment for undercharging is limited to three months. Regulation 11(3A), however, expressly says that this regime does not apply to offences under sections 37 or 38. Therefore, inspect TNB’s letter carefully: “meter irregularity” and deliberate “meter installation tampering” are legally different cases.
The absence of advance notice before inspection does not, by itself, invalidate TNB’s inspection
- Under regulation 7 of the Licensee Supply Regulations 1990, an authorised person or officer may enter premises supplied with electricity at a reasonable time for meter-related purposes upon production of proper evidence of authority. In Tenaga Nasional Bhd (TNB) v Evergrowth Aquaculture Sdn Bhd and other appeals [2021] 5 MLJ 937 (FC), the Federal Court held that TNB could rely on regulation 7 for inspection and that “reasonable time” is fact-sensitive; advance notification is not a statutory prerequisite. Accordingly, a defence consisting only of “TNB did not tell me before coming” is weak. The better questions concern authority to enter, the manner and time of inspection, what was actually discovered, and whether the evidence is reliable.
That does not mean TNB can inspect without maintaining a proper evidential trail
- ST’s official Panduan Prosedur Tuntutan Kerugian Hasil provides that, where the consumer or owner is absent and the meter is in an accessible or common area, inspection may proceed, but notification and appropriate records should be left. The Guide also calls for photographs and records of the premises, meter installation, abnormality, tests and condition before and after rectification. The Guide is an administrative guideline rather than subsidiary legislation, so non-compliance does not automatically destroy a claim. Nevertheless, evidential deficiencies matter. In Tenaga Nasional Bhd v DSP (M) Sdn Bhd [2026] MLJU 891, the Sessions Court dismissed TNB’s RM383,707.05 claim after identifying serious deficiencies including inconsistent photographs, technical and calibration issues and weaknesses in proving both tampering and loss.
The RM12,000 calculation is not beyond challenge
- Section 38(4) requires the certified written statement to specify the amount of lost revenue, the manner of calculation, the items of expense and the person said to be liable. Its statutory status is only prima facie evidence. It is rebuttable evidence, not a final adjudication by TNB of its own case. ST’s Guide recognises several methodologies, including pre/post-consumption averages, meter-accuracy error calculations, Maximum Demand calculations and Load Profile calculations. TNB should therefore be required to disclose the precise formula, data inputs, applicable tariff, consumption records and the evidential basis for the commencement date.
- ST’s Guide permits fraudulent-use calculations to look backwards for up to five years, depending on the evidence. Where there is an identifiable sustained sudden drop, that consumption history can determine the relevant period. Where there is no sudden drop, a period may be calculated backwards subject to the five-year guideline ceiling. Importantly, the Guide expressly recognises supporting documents such as water bills and tenancy agreements as evidence relevant to determining when the claimed loss period should begin. This five-year calculation guidance must still be read together with the statutory six-month proviso in section 38(3): where TNB seeks more than six months, the official Guide itself states that recovery must proceed through court.
A landlord cannot safely rely only on the statement, “My tenant did it, not me.”
- If the TNB account remained registered in the landlord’s name, the defence becomes substantially harder. In Tenaga Nasional Bhd v Ichi-Ban Plastic (M) Sdn Bhd and other appeals [2018] 3 MLJ 141; [2018] 3 CLJ 557 (FC), the Federal Court held that a criminal conviction for meter tampering is not a prerequisite to TNB’s civil recovery under section 38. The Federal Court also accepted that reasonable estimation may be used where precise measurement has become impossible. Evergrowth further demonstrates that TNB need not necessarily identify the individual who physically carried out the tampering before pursuing the civil loss-of-revenue claim. A bare denial of personal involvement is therefore not enough.
Consumers nevertheless do win these cases when TNB cannot prove its case
- In Tenaga Nasional Berhad v Quah Lian Wua, High Court Civil Appeal No. BA-12BNCvC-61-09/2024 (19 June 2025), TNB sought RM421,352.05 for an alleged 59 months of lost revenue. The Sessions Court dismissed the claim and the High Court dismissed TNB’s appeal. Among the critical findings were that the meter itself was intact and functioning, the relevant tapping point was within infrastructure not shown to be under the consumer’s control, and TNB had failed to produce sufficiently reliable evidence of its claimed loss. Likewise, DSP (M) Sdn Bhd [2026] MLJU 891 demonstrates that technical weaknesses in proving tampering, causation and quantum can result in TNB’s entire claim being dismissed.
- Another important landlord decision is Lim Keem Kok & Sons Realty Sdn Bhd v Tenaga Nasional Berhad, High Court Civil Appeal No. MA-12BNCvC-1-02/2026 (9 July 2026). The property owner initially faced a Sessions Court judgment of RM440,857.90. However, there had never been a registered electricity consumer or meter for the premises. The High Court allowed the owner’s appeal and dismissed TNB’s claim entirely because ownership of the premises alone did not prove that the owner was legally responsible for the unlawful abstraction or had received the benefit of the electricity. The case is important, but its protection is strongest where the owner was not the registered consumer; it should not be misread as automatically protecting a landlord whose own name remained on the TNB account.
Cases where TNB succeeds
- Tenaga Nasional Bhd v Sani bin Sahat [2026] MLJU 2127 is particularly relevant because the amount was RM12,569.85, very close to the RM12,000 example. TNB claimed under-recorded consumption from January 2020 to December 2024. It produced evidence of bypass wiring, photographs, testing, calibration material and a detailed meter-accuracy computation. The defendant substantially relied on denials and did not produce independent technical or expert evidence capable of dismantling TNB’s technical case. The Magistrates’ Court awarded TNB the full RM12,569.85. The practical lesson is straightforward: the strongest defence is not “I am innocent”; it is identifying precisely why TNB has failed to prove tampering, causation, the relevant period or quantum.
The first appeal should be made directly to TNB
- Lodge a formal written dispute within the period stated in the demand and expressly state that it is made without admission of liability and with all rights reserved. TNB’s own current meter-tampering FAQ confirms that customers may seek a negotiation session before the Jawatankuasa Khas Usikan Meter, arranged through the officer identified in the loss-of-revenue demand. TNB recommends bringing certified supporting documents such as the sale and purchase agreement, water bills and tenancy agreement. In addition, request the inspection report, photographs, test results, calibration certificates, meter/event logs, load-profile information, evidence supporting the commencement date and the complete calculation worksheet. TNB’s official complaint form is available at TNB Submit Enquiry & Complaint Online, and its billing/general enquiry number is 1300-88-5454.
If TNB does not resolve the matter, complain to Suruhanjaya Tenaga
- ST expressly accepts complaints relating to billing errors, failure by licensees to comply with proper procedures, unreasonable actions and unsatisfactory service. For a complaint involving TNB, ST requires the consumer to provide the earlier TNB complaint/ticket/reference number together with supporting documents. The online portal is Suruhanjaya Tenaga e-Aduan Consumer Complaint System, while the official requirements are set out at ST Before Making a Complaint. A professionally prepared complaint should not simply say “I did not steal electricity”. It should ask ST to examine the section 38 reporting requirements, inspection evidence, two-year retrospective period, commencement date and each component of the RM12,000 calculation.
There is no defensible published “market success rate”, fixed discount or statutory number of instalments
- Neither TNB’s nor ST’s current public material provides a reliable percentage saying that, for example, 50% of these appeals succeed or that consumers normally obtain a 30% reduction. Court outcomes illustrate why such figures would be misleading. Quah and DSP resulted in TNB’s claims being dismissed; Sani resulted in TNB recovering the full amount. In Tenaga Nasional Berhad v Choo Lee Chen, Civil Suit No. BL-A72NCvC-100-02/2024, TNB pleaded RM61,310.05, but after the court identified a computational-period problem, the corrected recoverable amount was RM26,146.70. That reduction was based on evidence and calculation, not a standard “discount”. Instalments are a matter for negotiation rather than an automatic statutory entitlement.
The practical conclusion is therefore evidence first, negotiation second
- Determine whether TNB alleges an ordinary meter fault or deliberate tampering; establish whose name was on the account; preserve the tenancy agreement and proof of the tenant’s occupation; demand TNB’s inspection and technical records; reconstruct consumption before and after the alleged event; and obtain an independent electrical expert where the amount justifies it. If TNB threatens disconnection after the alleged tampering has already been rectified, Tenaga Nasional Bhd v Chew Thai Kay & Anor [2022] 2 MLJ 25; [2022] 2 CLJ 333 (FC) is particularly important. The Federal Court held that once the impugned tampering has been rectified and the offending condition is no longer continuing, TNB cannot subsequently use section 38(1) disconnection as leverage for the historical loss; its recovery route is the civil claim contemplated by section 38(5).
Legal problems become expensive when a person saves on advice but makes the wrong first decision
- A consumer facing a TNB meter-tampering demand should not blindly reply, admit liability, sign a settlement, make a disputed payment or allow crucial evidence to disappear. What a paid consultation purchases is not a few sentences but an experienced lawyer’s assessment of the statutory classification, evidence, retrospective period, calculation, litigation risk and negotiating position.
