在签署了新公司所发出的录取通知书之后,准员工却在开工前不来上班。请问员工会被告吗?
- 在签署了录取通知书之后,视录取通知书的内容而定,相关录取通知书可构成有效合约。
- 在1950合约法令第二条文提到,(a)一方向对方表达他愿意做或放弃做某事,目的是为了获得对方同意有关行为时,他因此作出了一个要约;(b)受要约方若表示了相应的同意,则该要约被接受:被接受的要约为承诺。
- 简单来说,这代表当提出提案的人,以及接受的一方都同意有关提案时,该提案即被接受,而被接受的提案即成为一种承诺。
- 如果被接受的要约或提案成为承诺 ,违背的一方,可面临法律上的责任。因此如果相关录取通知书构成了一份有效合约,当员工直接不去上班时,员工的行为可构成违约,而准公司有权利入禀法庭,对员工采取民事诉讼。
那么在签署了新公司所发出的录取通知书之后,新公司之后却通知员工不需要来上班。请问员工可以告雇主吗?
- 同样的,如果是雇主在员工已经签署录取通知书后,却突然通知员工取消录取他,也是违背了合约内容,员工可以针对此事委任律师,对违约的老板采取民事诉讼。

本法中,下列词语与表达在如下意义上使用,除非文本中另有相反解释:
(a)一方向对方表达他愿意做或放弃做某事,目的是为了获得对方同意其为或不为该行为,他作出了一要约;
(b)受要约方表示了相应的同意,则该要约被接受:被接受的要约为允诺;
(c)作出要约的一方被称为“许诺人”,接受要约的一方被称为“承诺人;
(d)依许诺人的要求,承诺人或任何他人已经或正在做或不做某事,或保证做或不做某事,该行为、禁止或保证被称为对允诺的“约因”;
(e)每一允诺或一组允诺,与对应的约因构成一协议;
(f)多个允诺之间互相构成约因或部分约因的,称为互相允诺;
(g)不可由法律强制执行的协议是无效;
(h)可由法律强制执行的协议是合同;
(i)一方或多方中的几方主体可选择依法强制执行该协议,而他方或其他几方却无权,该协议为可撤销合同;和
(J)当合同依法不具可执行力时,该合同在不具有可强制执行力时无效。
第7条 承诺必须是确定的
为了将要约转为允诺,承诺必须:
(a)确定和完全;
(b)用通常与合理的方式表达,除非要约已规定了承诺的方式。若要约已规定了承诺的方式,而承诺却未以该方式为之,要约人于收到承诺后的合理时间内可以坚持要约须以预定的方式承诺,而不是其他方式;如要约人未如此行为,则他已接受承诺。

2.Interpretation
In this Act the following words and expressions are used in the following senses, unless a contrary intention appears from the context:
(a) when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence, he is said to make a proposal; (b) when the person to whom the proposal is made signifies his assent thereto, the proposal is said to be accepted: a proposal, when accepted, becomes a promise;
(c) the person making the proposal is called the “promisor” and the person accepting the proposal is called the “promisee”;
(d) when, at the desire of the promisor, the promisee or any other person has done or abstained from doing, or does or abstains from doing, or promises to do or to abstain from doing, something, such act or abstinence or promise is called a consideration for the promise;
(e) every promise and every set of promises, forming the consideration for each other, is an agreement;
(f) promises which form the consideration or part of the consideration for each other are called reciprocal promises;
(g) an agreement not enforceable by law is said to be void;
(h) an agreement enforceable by law is a contract;
(i) an agreement which is enforceable by law at the option of one or more of the parties thereto, but not at the option of the other or others, is a voidable contract; and
(j) a contract which ceases to be enforceable by law becomes void when it ceases to be enforceable.
7.Acceptance must be absolute 7. In order to convert a proposal into a promise the acceptance must—
(a) be absolute and unqualified;
(b) be expressed in some usual and reasonable manner, unless the proposal prescribes the manner in which it is to be accepted. If the proposal prescribes a manner in which it is to be accepted, and the acceptance is not made in that manner, the proposer may, within a reasonable time after the acceptance is communicated to him, insist that his proposal shall be accepted in the prescribed manner, and not otherwise; but, if he fails to do so, he accepts the acceptance.
