答:如果员工从公司辞职或他的服务被公司终止,他只有权享有5个月的年假比例而不是整年的年假。An employee is only entitled to a proportionate annual leave for 5 months if he/she resigns from the company or his/her services are terminated by the company.
- 很多马来西亚雇主与员工都会问同一个问题:员工做了5个月,能不能立刻享受带薪年假(paid annual leave)?答案要分情况,因为法律把“年假 entitlement(法定年假权利)”与“年假比例 pro-rated annual leave(按月折算)”分开处理。
- 先讲最核心的法律:在西马与纳闽(Labuan),私人界雇佣关系主要受《Akta Kerja 1955 / Employment Act 1955》规管,而2022年修法已于2023年1月1日生效,并扩展对“所有员工”的适用范围(但部分项目仍有薪金门槛例外)。
- 《Employment Act 1955》第60E条规定了法定年假的“基本天数”:若员工在同一雇主下连续服务满12个月,每12个月的法定年假最低为8天、12天或16天(视服务年限而定)。
- 关键点来了:员工“服务5个月”时,如果合约还在继续、雇佣关系没有结束,严格来说,他还未完成12个月的“年假周期”,法律意义上的“法定年假(以12个月为单位)”通常还未到“必须给完一整年”的阶段。
- 但是,这不代表员工“完全没有年假”。很多公司的人事制度会采用“年假按月累积(accrual)或先借后扣(advance leave)”的做法,让员工在第1个月、第3个月或试用期内也可以先申请年假。这属于雇主给的更优待遇或公司政策,只要不低于法律最低标准,一般是允许的。
- 换句话说,你要把问题拆成两层:第一层是“公司政策有没有让你提早用年假”;第二层才是“法律在合约终止时,年假比例怎么算、要不要折现赔钱”。这两个层次混在一起,就会出现很多误解。
- 真正会触发“年假比例(proportionate / pro-rated annual leave)”的最常见情景,是员工在当年的年假周期尚未走完时离职,或雇主在年内终止员工服务。第60E条写得很清楚:若在合约终止的那一年里,员工未完成12个月连续服务,他的年假权利要按“已完成的月份”直接折算。
- 所以,员工“在服务5个月时,不是自动享有一整年的年假”;而是当他在第5个月就离职或被终止时,法律会把他当年应得的年假按5个月比例计算。
- 计算方式通常是:法定年假天数 ×(已完成月份 ÷ 12)。举例:员工属于“少于2年服务”的类别,法定年假最低8天;若他做满5个完整月后离职,年假比例就是8 × 5/12 = 3.33天。
- 法律还有一个很实务的“进位规则”:折算后若出现小数,少于半天就不算;半天或以上要当作一天。这一条在第60E条的但书里写得很明确,所以HR在结算final pay时不能随意“向下砍”。
- 另外,第60E条也规定:年假是“额外的福利”,必须加在休息日与公共假期之上,不能用“周休/公假”去抵掉年假。
- 再来一个常见争议:员工离职时,年假是让他“放完”还是“折现”?第60E条允许在合约终止前安排员工把当年应得的年假先用完;如果合约在年内终止而员工还没放完年假,雇主一般需要按“ordinary rate of pay(普通工资日薪)”支付未休年假的工资。
- “ordinary rate of pay”怎么计算?第60I条给了公式:月薪员工一般用月薪÷26来算一日普通工资(也允许更有利于员工的方法,但不能算得更低)。这点对结算未休年假很关键。
- 若员工是因为严重不当行为,经适当调查后在第14(1)(a)条下被即时解雇(dismiss without notice),第60E(3A)的“未休年假折现”规则会出现限制(法律文字上明确排除该情形)。
- 对“兼职员工(part-time employee)”,规则不同但逻辑相同。2010年《Employment (Part-Time Employees) Regulations》也规定:兼职员工若在合约终止的那一年未完成12个月服务,其年假要按已完成月份折算;并且一般需要支付未使用的年假(除非因不当行为终止)。
- 还有一个容易被忽略的“失格条款”:若员工在该12个月周期里无故旷工超过工作日的10%,他可能会失去该周期的年假权利。雇主若要引用这一条,必须保存良好的出勤、请假与警告记录,否则很难在争议中站得住。
- 从雇主合规与风险管理角度,我通常建议公司把“年假比例”写进员工手册或雇佣合约的请假政策里,至少要写清楚三件事:第一,年假周期(calendar year还是anniversary year);第二,累积方式(按月累积、一次性发放、或试用期限制);第三,离职结算方式(按完成月折算、进位规则、小数处理)。
- 若员工与雇主对年假比例或折现有争议,法律上可向劳工局(Director General of Labour / JTKSM)提出申诉或启动调查程序;但实务上,很多案件输赢关键不在“公式”,而在证据:合约条款、员工手册版本、批假记录、薪资单、出勤记录、终止信与最终结算明细。
- 最后提醒一句:本文讨论的是西马与纳闽适用的《Employment Act 1955》框架;沙巴与砂拉越仍以各自的劳工条例为主,处理方式与条文细节可能不同,不能直接套用。
- 总结:员工服务5个月时,“有没有年假”要看公司政策;但如果员工在第5个月离职或被终止,法律通常只承认“按5个月比例折算”的年假,而不是整年年假;折算后的小数要按“半天进位规则”处理,并且离职时未休年假通常需要按普通工资折现(特定不当行为解雇例外除外)。
- A common Malaysian workplace question is this: “After 5 months’ service, is an employee entitled to paid annual leave?” The correct answer depends on the scenario, because Malaysian law distinguishes between (i) contractual/company practice on leave accrual during employment, and (ii) statutory pro-ration when the contract ends mid-cycle.
- In Peninsular Malaysia and the Federal Territory of Labuan, the principal legislation is the Employment Act 1955 (Act 265). The 2022 amendments came into force on 1 January 2023, and the Department of Labour (JTKSM) confirms a broader coverage to employees (subject to specific exceptions for certain benefits).
- Statutory annual leave is governed by section 60E of the Employment Act 1955. In simple terms, the Act prescribes minimum annual leave “for every twelve months of continuous service” (8, 12, or 16 days depending on length of service).
- Therefore, if an employee has served only 5 months and the employment relationship continues (i.e., the contract has not ended), the employee is generally not “automatically entitled to a full year’s statutory annual leave” as if 12 months have been completed. The statutory structure is built around a 12-month continuous service cycle.
- That said, many employers in Malaysia allow annual leave to be taken earlier through internal policy (monthly accrual, advance leave, or pro-rata utilisation during probation). This is a contractual or policy benefit. It is lawful so long as it does not provide terms less favourable than the statutory minimum.
- The real legal flashpoint is usually not “leave after 5 months while still employed”, but rather “what happens when the employee resigns or is terminated after 5 months.” This is where the concept of proportionate (pro-rated) annual leave matters most.
- Section 60E expressly provides that where an employee has not completed twelve months of continuous service “during the year in which his contract of service terminates”, the employee’s paid annual leave entitlement is to be in direct proportion to the number of completed months of service. In other words: mid-year resignation/termination triggers pro-ration.
- Your original draft answer is directionally correct, but it becomes legally precise once the key condition is stated upfront: pro-rated annual leave is principally relevant when the contract ends (resignation or termination) before the completion of the 12-month cycle.
- The practical computation usually follows this approach: statutory annual leave days × (completed months ÷ 12). Example: an employee with less than two years’ service has a statutory minimum of 8 days per 12 months. If the employee leaves after 5 completed months, the proportionate entitlement is 8 × 5/12 = 3.33 days.
- The Act also contains a crucial rounding rule: if the fraction of a day calculated is less than half-day, it is disregarded; if it is half-day or more, it is deemed to be one full day. This prevents arbitrary “downward trimming” in final leave calculations.
- Section 60E further clarifies that annual leave is in addition to rest days and paid public holidays; employers cannot “absorb” annual leave by pointing to weekly off-days or gazetted holidays.
- On termination, the Act contemplates that the employee may take accrued annual leave before the termination takes effect. Where the contract ends before the employee has taken the annual leave entitlement, the employer is generally required to pay the employee the ordinary rate of pay in respect of each day of such leave (subject to statutory exceptions).
- “Ordinary rate of pay” is not a vague concept; it is defined and supported by a statutory formula under section 60I. For monthly-rated employees, the statutory formula commonly used is monthly rate of pay ÷ 26 (and any alternative method adopted must not produce a lower rate). This definition materially affects leave encashment in final pay.
- A major exception must be highlighted for compliance and dispute strategy: where an employee is dismissed for misconduct under section 14(1)(a) (dismissal without notice after due inquiry), section 60E(3A) contains an express carve-out affecting payment in lieu of untaken annual leave. Employers should never assume this exception applies; the disciplinary process and evidence must be properly documented.
- For part-time employees, the Employment (Part-Time Employees) Regulations 2010 provide a parallel structure: annual leave entitlement, pro-ration when the contract terminates before 12 months, and payment for unutilised annual leave upon termination (save where termination is on grounds of misconduct).
- There is also a “disentitlement” risk: section 60E includes a condition where excessive unauthorised absence (more than 10% of working days during the relevant 12-month period) can affect annual leave entitlement. Employers who rely on this must keep clear attendance and approval records, or the position may collapse in a dispute.
- From a best-practice standpoint, employers should record (in the employment contract and/or handbook) three practical items: the leave year (calendar year vs anniversary year), the accrual method (monthly accrual/advance leave), and the termination computation method (completed months, rounding rule, and final pay treatment). Clear drafting reduces complaints and enhances HR defensibility.
- If a dispute arises, employees may lodge a complaint with the Director General of Labour and trigger the statutory inquiry process; however, in practice, outcomes often turn on documents rather than formulas—employment contract terms, the latest handbook version, leave application history, payslips, attendance records, termination letters, and the final settlement breakdown.
- A jurisdiction reminder is necessary: JTKSM’s official guidance confirms that the amended Employment Act 1955 applies to Peninsular Malaysia and Labuan, while Sabah and Sarawak continue under their respective Labour Ordinances until amended. Do not blindly apply Peninsular rules to East Malaysia cases.
- In summary: after 5 months’ service, an employee is not automatically entitled to a full year’s statutory annual leave; but if the employee resigns or is terminated after 5 completed months, the statutory entitlement is commonly pro-rated to completed months, with rounding rules, and untaken leave is generally payable at the ordinary rate of pay (subject to misconduct dismissal exceptions).
