问:劳工法里员工一年可以享有多少的年假?

1955年劳工法令第60E条文“年假”:

(1)雇员有权享有以下有薪年假:

  1. 工作少过两年者, 每十二个月不断的服务可领取八天。
  2. 工作两年但少过五年者, 每十二个月不断的服务可领取十二天。
  3. 工作超过五年者, 每十二个月不断的服务可领取十六天。
    *如果雇员在契约终止时工作不到十二月, 他的有薪假期享有权跟有做工月数成正比。
    *如果所计算出来的年假不到一天, 少过半天将不被理会, 而超过半天者就当作一天。
    *还有, 若雇员在十二个月中没有好的理由而缺勤超过十巴仙工作日的总日数, 他将无权享有年假。

 

问:如果员工未经上级批准申请年假,公司是否有必须批准他的年假?

答:年假只能由员工的上司批准。员工在休假前,必须获得此类批准。提交申请年假表格只是一个申请程序,但获得批准是必须的。

Q: If an employee applies for annual leave without obtaining the approval of his superior, is the company obliged to approve such annual leave?

A: Annual leave is only approved by the superior of the employee. The employee must obtain such approval before he goes on such leave. The mere submission of a leave application form is only an application but obtaining the approval is a MUST.
