问:薪水已经被扣EPF,但EPF户口没有进到。如何举报?

1991年雇员公积金法令第43(2)条文,该法令规定所有雇主必须在每月15日或之前缴纳雇员公积金,一旦罪成,将判处不超过三年监禁或不超过1万令吉的罚款,或两者兼施。

  • 雇主必须按月支付雇员工资规定的费率与雇主的份额。
  • 雇主需要在未支付员工工资前,按照指定的缴纳比例扣除雇员需缴纳的数额才能支付员工工资。
  • 雇主与雇员的份额必须在下个月的15日之前提交至公积金。需留意的是,即使是part time员工,都享有公积金的福利。
  • 若你的薪水已经被扣公积金,但没有被进过epf, 或者老板没有为你缴付过任何公积金,可以向公积金局和劳工部做出举报。
  • 对犯错的雇主,法庭通常会限他们于6个月内,以分期付款方式偿还拖欠的公积金。
  • 为确保犯错的雇主全额支付拖欠的公积金,公积金局会在偿还时限内,严密监察他们。
  • 请带上你的offer letter, 公司进薪水的银行statement让有关官员做审查。

问:工作没有合约,也没有进epf 和社险,如何是好?

  • 员工可以要求老板立一份contract of service.如果老板拒绝,可以向劳工部举报。
  • 老板需要缴付你的epf 和soso。如果老板拒绝,你可以收集薪水单或银行statement, 和公司打卡,到kwsp和perkeso部门举报老板没有为你缴付Epf。
  • 即使是part time员工, 老板都需要缴付EPF和社险。
  • 雇主需在30天内为员工注册社险和缴付社险费;违规雇主可在1969年雇员社会保险法令或 2017年就业保险计划法令下,将会被开出不多于5000令吉罚款;若无法及时还清,将被提控上庭并面对最高1万令吉罚款、监禁不超过2年,或两者兼施的刑罚。
  • 延迟为伤者注册和缴交社险保费的雇主已抵触了1969年雇员社险法令第5条文,一旦罪成可被判两年监禁,或罚款不超过1万令吉,或两者兼施。
  • 需要留意的是,如果公司和员工的关系是 CONTRACT FOR SERVICES ( Company & independent worker/contractor) ,那工人是自己负责他的个人所得税。公司是没有为他们缴付EPF 和SOCSO的

Section 43

Rate of contributions

(1) Subject to the provisions of section 52, every employee and every employer of a person who is an employee within the meaning of this Act shall be liable to pay monthly contributions on the amount of wages at the rate respectively set out in the Third Schedule.

(1A) Subject to section 52, the monthly contribution of every employee and employer who are subject to the minimum wages order made under the National Wages Consultative Council Act 2011 [Act 732] shall not be less than the monthly contributions based on the amount of the minimum wages for the month as determined under the minimum wages order at the rate respectively set out in the Third Schedule.

(2) Any person being an employer who fails, within such period as may be prescribed by the Minister, to pay to the Fund any contributions which he is liable under this Act to pay in respect of or on behalf of any employee in respect of any month shall be guilty of an offence and shall, on conviction, be liable to imprisonment for a term not exceeding three years or to a fine not exceeding ten thousand ringgit or to both.
