问:在试用期内,雇主是否有权在,在给予适当通知的情况下,甚至只是24小时通知,随时终止在试用期员工的服务?

答:

  • 不能。 你是不能随意在试用期内, 给24小时通知,辞退试用期员工。
  • 在员工的试用期内解雇员工和在试用期满时终止员工服务,这两个情况是有区别的。
  • 在试用期内,试用期员工是享有与永久员工相同的权利。除非基于不当行为或其他充分理由,否则其服务不能随意终止(工业法院判决第191/80)。
  • 因此,在试用期结束时,他的服务可以在24小时后终止,如果员工根据1967年劳资关系法令第20条文,提出不当解雇的投诉,雇主只需要证明雇员不符合公司要求,所以没有确认为永久员工。

A:

  • No, you cannot simply terminate an employee under probationary period with a 24 hours notice.
  • There is a distinction between dismissal within his probationary period and termination of service at the expiry of the probation or thereafter.
  • Within the period or probation, the employee has the same rights as a permanent employee and his services cannot be terminated except on the ground of misconduct or other sufficient reason (Industrial Court Award No 191/80).
  • Therefore, at the end of the probationary period his services may be terminated by 24 hours and if the employee lodges a complaint under section 20, Industrial Relations Act 1967 for wrongful dismissal, the employer only has to show cause that the employee does not meet the company’s requirements for confirmation.
